GENERAL CONDITIONS OF SALE
The present general conditions of sale and use of the site apply between :
The company Alice Magnin, registered with the Chamber of Trades under the number SIREN 5138362800030, whose registered office is located at the address: Villa Solidor, 14 Place du Château, 06 800 Cagnes-sur-mer, France and any natural person of legal age acting exclusively within the strict framework of his/her personal needs, who consults the website www.alicemagnin.com and/or makes a purchase from Alice Magnin.
We ask You to carefully read the Agreement (as defined below) before using the Site and/or placing any order with Alice Magnin insofar as this Agreement affects Your rights and obligations. The use of the Site and/or the placing of any order shall constitute knowledge and acceptance by You of the Agreement. If You do not agree with any of these provisions, You are not authorized to use all or part of the Site and/or to place any order.
Please print a copy of the Agreement for Your records.
1 PAYMENTS
For online purchases, all payments must be received within three days of purchase. For in-store purchases, payments must be received upon receipt of merchandise.
ART1.1 CUSTOM AND HALF-MEASURE
When an order is taken in our workshop or at a distance, we will ask for a deposit of 60% of the total amount of your order. Only the payment of this deposit will allow us to start the manufacturing of your order. The deposit can be paid at the workshop by check, cash (up to 1000) or credit card. At a distance, it can be made by bank transfer. As with cheques, we will confirm the start of the production of your order when we receive your transfer on our account. No proof of transfer transmitted by you can be used to accelerate the manufacturing process. We therefore invite you to adapt your choice of payment method according to your delivery/collection date requirements. The remaining 40% must be paid before delivery.
ART1.2 RETURNS AND REFUNDS
The Customer has a period of 14 clear days from receipt of the product ordered to exercise his right of withdrawal without having to justify his reasons or pay penalties except, where appropriate, the cost of return which remains the responsibility of the Customer. It is underlined that the right of withdrawal cannot be exercised by the Customer for the contracts of supply of products made according to the specifications of the Customer or clearly personalized in accordance with the article L.121-20-2 of the Code of the consumption. When the Customer exercises his right of withdrawal by sending the products to the workshop, the products must be returned in perfect condition and complete, accompanied by the original packaging, please contact me at the following address alicemagnin01@gmail.com. The return of the Products is carried out under the responsibility of the Customer. Considering the value of the products, it is thus advised to the Customer to make the return in Declared Value with acknowledgement of receipt.
Are considered as personalized products:
- Engraved jewelry
- Jewelry ordered with a stone chosen by the customer
- Jewelry ordered in a size or length that is not part of our standard sizes
- Jewelry made to measure and half-measure
ART1.3 PRICE CHANGES
Alice Magnin reserves the right to modify its prices at any time and without notice. Products already ordered will continue to be invoiced at the rates in effect at the time your order is placed.
2 DELIVERIES
ART.2 DELIVERY TIMES
ART 2.1.1 FRANCE
- If you have selected the option "Pick up in our workshop", please contact me to make an appointment within 10 working days. You will be asked for an ID to hand over your purchase. The workshop and the appointments are from Wednesday to Saturday included, from 2 pm to 6 pm.
- Shipments: according to the value and the destination of the parcel your sending will be carried out either in Declared Value, or in Colissimo, the times are from two to five working days for France and two to eight working days for Corsica and Monaco.
ART 2.1.2 EUROPEAN COMMUNITY
Shipments within the European Community are made by Declared Value or Colissimo depending on the jewel sent, the time limits are from two to eight working days depending on the destination.
ART 2.1.3 OUTSIDE THE EUROPEAN COMMUNITY, UNITED KINGDOM AND SWITZERLAND
Shipments outside the European Community are sent by Colissimo, Chronopost or Fedex Express depending on the value of the item sent and the destination country. - Colissimo International: 4 to 8 working days for purchases under 500 euros.
- Chronopost: 2 to 6 working days for purchases from 500 to 1500 euros
- Fedex Express (with Ferrari insurance): 2 to 6 days minimum for purchases over 1500 euros.
Delivery times vary according to customs clearance, which can be more or less long. We invite you to anticipate your purchases according to your needs and contact us for any question. A parcel number will be given to you so that you can follow your parcel. If you are absent at the time of delivery, the letter carrier will leave you a notice of passage allowing you to withdraw your parcel at the Post office. We could not be held responsible for the incompressible delays of the postal services if you chose a solution not adapted to the urgency of your request, nor for the imponderables of the latter (strikes, delays in the routing, etc.). We will of course do our utmost to assist you in all situations.
ART 2.2 CUSTOMS FEES
For any order to a country outside the European Union, the Customer is the importer of the product(s) ordered. Customs duties, import duties or state taxes may be due. These rights will be charged to the customer and under his responsibility, both in terms of declarations and payments to the authorities and / or competent bodies. The customer is advised to check with the competent authorities of his country.
ART2.3 OBSERVATIONS ON THE DELIVERY AND ON THE DELIVERED PRODUCTS
You must imperatively check the packages and the products upon delivery. If you have any reservation or observation justifying that the products be returned to us, you must proceed as indicated in article 4 below.
ART2.4 PROPERTY - RISKS
The transfer of ownership and risks on the products takes place at the delivery of the products. However, in the case where the two conditions A and B below are met:
Condition A
Your package is returned to us by the carrier because the address is wrong or you do not claim it within the time limit or you do not answer the phone, our voice and electronic messages to plan the withdrawal of your products in store (especially if the email addresses or phone numbers you have sent us are wrong) or you do not show up for the planned withdrawal in store,
Condition B
You do not answer the telephone, our voice and electronic messages to notify you of the situation (in particular if the e-mail addresses and telephone numbers you have given us are erroneous), and we are therefore unable to contact you for a period of 3 months from the date of shipment of the package or contact for the planned in-store pick-up of the product, or from the planned date of pick-up,
Alice Magnin then retains ownership of the products and may freely dispose of them. Alice Magnin retains the payments that triggered the production of the product in the first place, and you agree to have no recourse to recover the amounts paid or the unclaimed products.
ART2.5 FAILURE TO DELIVER OR DELIVERY OF A DAMAGED OR SPOILED PRODUCT
In the event that the carrier indicates that it has delivered the product you ordered and you dispute that such delivery has taken place or you have refused a package presented damaged or spoiled by the carrier, you agree to return to us a signed statement acknowledging the absence of delivery or the delivery of a damaged or spoiled product, a copy of a proof of identity, and a copy of a proof of address less than three months old, so that Alice Magnin can take charge of the cost of a new shipment of said product.
3 AFTER-SALES SERVICE
ART3.1 WARRANTY
Our jewelry is designed with 25 years of experience in working with precious materials. This in order to bring you an optimal quality in the conception of the produced pieces. However, the precious jewels remain delicate objects which require a particular attention. If you notice a problem with your jewelry, do not hesitate to place it safely in its case and contact us as soon as possible. We offer a one year warranty for potential manufacturing defects. Deformations due to hanging, stretching, accident or normal wear and tear are not included in the warranty. Beyond that, we will assist you in the repair of your jewel according to the situation encountered.
ART3.2 WARRANTY CONDITIONS 1
We invite you to contact us if you have any questions regarding the maintenance of your jewelry and if you wish to have it checked in our workshop in order to give it the attention it needs for its long life. Any Alice Magnin jewel that has not been found to be defective by us, or that has been repaired or reworked in another workshop, will not be covered by our warranty.
ART3.3 WARRANTY CONDITIONS 2
All parcels from countries outside the European Community sent for repair or return must be clearly labeled and announced as RETURN or REPAIR in order not to incur customs fees. In the event that customs fees are applied, the package will be
applied, the package will either be refused or the customs fees will be subtracted from the

4 APPLICABLE LAW, DISPUTES
ART4.1 JURISDICTION IN FORCE
The present general conditions of sale are subject to French law, regardless of the country of delivery. In the event of a legal dispute, only the French courts will have jurisdiction. In the event of a dispute arising from the present contractual relationship, the Client and Alice Magnin undertake to seek an amicable solution before any legal action is taken. The invalidity or unlawfulness of one of the clauses of the present general terms and conditions of sale shall not invalidate the said terms and conditions; the clause to be inserted in place of the invalidated clause shall be the one in force.
ART4.2 MEDIATION
In accordance with Article L. 612-1 of the French Consumer Code, you may have free recourse to the CM2C mediation service to which we belong by electronic means or by post: CM2C - 14 rue Saint Jean - 75017 PARIS.
5 TRUSTED
ART5 INSURANCE
The deposited goods may be insured by the depositing client, via his insurer, with a waiver of recourse against Alice Magnin

7 INTELLECTUAL PROPERTY

All rights relating to the Site and to the overall concept of the Company's activity, to their original and innovative character, in particular the intellectual property rights over the jewelry collections, unique pieces, literary and artistic creations, graphics (including photographs) and audiovisuals and other works of the mind and, more generally, all creations likely to be protected by intellectual property law such as images logos, the layout, the graphic charter, the structure, the ergonomics, the color codes, the typography, the fonts, the basic graphic elements, the graphic organization of the screens, the layout, the page backgrounds, the visual identity of the Site, belong to the Company or are regularly exploited by the latter, without any limitation.

The client undertakes not to directly or indirectly harm the Company, the Site or the Company's rights. Consequently, the present general terms of sale shall not constitute a transfer of the Company's intellectual property rights and the client acknowledges that he/she is not authorized to download, reproduce, represent, modify, translate and/or adapt, partially or totally, for a fee or free of charge, all or part of the Site and each of the elements that make it up, and to reproduce and/or represent such translations, adaptations and modifications, partially or totally, for a fee or free of charge, without the prior written consent of the Company.
